SAFETY Act Certification and Designation Awarded to Burnham Brown's Client D. W. Nicholson, Inc.

Burnham Brown is pleased to announce that on January 7, 2009, the Department of Homeland Security awarded a SAFETY Act Designation and Certification to Burnham Brown's client, D. W. Nicholson, Inc. The SAFETY Act is new legislation that Congress passed after the 9/11 terrorism attack. It established a new program of extensive liability protection for contractors that design and/or install anti-terrorism devices. D. W. Nicholson is a national mechanical, electrical and structural steel fabrication contractor. It sought SAFETY Act protection for its work in the procurement, installation and integration of explosive detection devices for baggage and cargo handling systems at airports. Prior to the SAFETY Act award, D. W. Nicholson had worked on five baggage handling/explosive detection systems at the San Francisco International Airport. The SAFETY Act is now in its sixth year. In that time, only 125 businesses and contractors have successfully applied for SAFETY Act protection. The Hayward-based D. W. Nicholson now joins the ranks of some of the largest and best-known contractors in the country who have SAFETY Act protection.

The SAFETY Act award was the culmination of an 18-month application process by Burnham Brown and D. W. Nicholson. The application involved hundreds of pages of technical documentation describing D. W. Nicholson's safety policies, quality control program, policies for selecting subcontractors, consultants and material suppliers, plus extensive information about D. W. Nicholson's insurance coverage and financial background. The application included a detailed case history of every aspect of D. W. Nicholson's work on the design and installation of a baggage handling project with explosive detection capability on one of its five projects at the San Francisco International Airport.

With the protection afforded by the SAFETY Act Designation and Certification, D. W. Nicholson can continue to develop its expertise in the installation of baggage handling and explosive detection systems that are so critical to our nation's protection and security.
