Paul Caleo obtained a judgment of non-suit pursuant to Cal. Code Civ. Proc. § 581c for a national retailer on February 14, 2013 in Los Angeles Superior Court
Through a series of requests for admission and the preclusive effect of the motions in limine granted in Defendant's favor, Defendant established that Plaintiff could not, with sufficient evidence, demonstrate that Defendant breached the standard of care for keeping its premises in a safe condition. Consequently, the trial judge ruled that Plaintiff could not satisfy the requirements necessary to prove his prima facie case for premises liability/negligence resulting in a defense verdict after the conclusion of Plaintiff's opening statement.
