Southern California Jury Hits Plaintiff With 60% Fault For Accident And Rejects Brain Damage Claim

Burnham Brown trial attorneys Paul Caleo and Aimee Hamoy-Perera successfully defended Home Depot U.S.A. Inc. in a 5-week jury trial in Kern County Superior Court from February 4th to March 8, 2017.
Plaintiff Martin Anguiano claimed he suffered injuries to his shoulder, low back, neck and a mild traumatic brain injury (mTBI) after a slip and fall at a store in Ridgecrest, CA. At trial, Plaintiff sought over $12 million in economic and non-economic damages.
The case was tried in 2 phases - liability and damages. The jury deliberated for 3 days on liability, finding Plaintiff 60% at fault and Defendant 40% at fault. Following another 10 days of evidence, the jury then deliberated for 1 and 1/2 days on the issues of damages, ultimately rendering a total verdict under $1 million. Applying the calculations from the liability phase, final judgment was awarded for just over $367,000.00. For more details, see link below.
